Terms of service

Living Water Christian Cruise (LWCC)

Terms of Service & Participant Agreement

These Terms of Service & Participant Agreement (“Terms”) govern your purchase, booking, registration, and participation in any Living Water Christian Cruise program, including onboard conferences, gatherings, worship services, meetups, group communications, and related activities (collectively, the “LWCC Program”). By booking, paying any amount (including a deposit), registering, attending, or participating, you (“Participant,” “you”) agree to these Terms.

If you do not agree, do not book and do not participate.

1) Who LWCC Is (And Is Not)

1. LWCC is an event/group/tour organizer. LWCC organizes faith-based group travel participation and programming typically on Royal Caribbean International ships (and may use other cruise lines from time to time).

2. LWCC is not the cruise line. LWCC does not own, operate, staff, crew, captain, or control the vessel.

3. Cruise line authority controls onboard. Shipboard operations, security decisions, and onboard rules are controlled by the cruise line and its crew/security. If ship security intervenes, ship security has final say for onboard matters.

2) Incorporation of Cruise Line Ticket Contract + Policies

1. You must comply with cruise line terms. Your cruise is governed by the cruise line’s ticket contract and policies (the “Cruise Line Terms”), including but not limited to age rules, alcohol rules, prohibited items, guest conduct, health/safety requirements, and security procedures. Royal Caribbean’s ticket contract contains important limitations and legal terms you must read.

2. LWCC rules are additional. These Terms add LWCC-specific conduct rules that may be stricter than the cruise line’s baseline rules.

3. Where conflicts exist. For onboard matters, the cruise line’s rules and security decisions control.

3) Program Types and Eligibility (YA Cruise vs Family Cruise)

3.1 Young Adults Cruise (“YA Cruise”)

1. Primary age range: 18–34.

2. Limited exceptions (case-by-case): Parents and/or children may accompany a YA Cruise Participant only for a specific reason and only with LWCC’s prior approval.

3. Minors under 18 on YA Cruise: If a child under 18 is approved to attend the YA Cruise, the parent/guardian agrees the child must be placed in and remain under the ship’s daycare/kids club supervision during LWCC programming and/or as required by LWCC staff for the safety and integrity of the YA Cruise environment.

3.2 Family Cruise

1. All ages allowed.

2. Minors must be with a parent/guardian. Every minor must be accompanied by their parent or legal guardian.

4) Booking Age Requirement (Royal Caribbean / Cruise Line Rule)

Royal Caribbean’s age policy states that for voyages originating in North America, no guest under 21 will be assigned to a stateroom unless accompanied in the same stateroom by an adult 21+, with limited exceptions.

Accordingly:

1. A 21+ adult is required in each stateroom where the cruise line requires it (including most North America-origin sailings).

2. LWCC may require proof of age and may refuse participation if you cannot meet cruise line age/assignment rules.

5) Deposits, Payments, and Your Agreement Method

1. Variable pricing and deposit terms. Deposits, due dates, and payment schedules vary by sailing and will be listed on LWCC’s booking website at the time you book.

2. Deposits are nonrefundable. All deposits are nonrefundable unless LWCC explicitly states otherwise in writing for a specific sailing.

3. Agreement is required before payment. You will be required to affirm these Terms (checkbox/e-sign or written contract) before paying a deposit or full balance.

4. Card on file authorization. You authorize LWCC to charge the payment method you provide (or keep on file via a payment processor) for:

balances due,

violation fees (Section 15),

costs LWCC incurs due to your breach of these Terms (where permitted).

6) Cancellations, Refunds, and Trip Interruptions

  1. Participant Cancellations & Governing Policy
All participant cancellations must be submitted in writing. Cancellation terms are governed by the cruise line’s cancellation policy in effect on the date LWCC receives your written cancellation request, plus LWCC’s nonrefundable deposits/fees. LWCC cannot waive, reduce, or override cruise line penalties. The date LWCC receives the cancellation request controls (not the date it is sent).
  2. Cruise Line Cancellation Charges (Schedule)
The following cancellation schedule is provided for convenience and reflects the cruise line table shown in the policy materials. If the cruise line updates its policy, the version in effect when LWCC receives your cancellation governs.

A) For 1 to 4 nights cruises (including Holiday sailings)

If cancellation is made…

Cancellation charge

75 days or more prior to the first day of the Cruise

No charge (except for Nonrefundable Deposit amounts)

74 to 61 days

50% of total price

60 to 31 days

75% of total price

30 days or less

100% of total price (No refund)

B) For 5 to 14 nights cruises (including Holiday sailings and Cruisetours)

If cancellation is made…

Cancellation charge

90 days or more prior to the first day of the Cruise

No charge (except for Nonrefundable Deposit amounts)

89 to 75 days

25% of total price

74 to 61 days

50% of total price

60 to 31 days

75% of total price

30 days or less

100% of total price (No refund)

  1. No-Shows, Late Arrival, and Failure to Board
No-shows, late arrivals, missed embarkation, denied boarding, failure to provide required documentation, or failure to pay remaining balances by the due date will be treated as a same-day cancellation, and may result in no refund.
  2. Refund Method & Timing
If—and only if—the cruise line authorizes a refund, the refundable portion (after all cruise line penalties and LWCC nonrefundable deposits/fees) will be returned to the original payment method. LWCC is not responsible for cruise line processing times, delays, chargebacks, or refund denials.
  3. Trip Interruptions / Changes After Departure
No refunds will be issued for trip interruptions, itinerary changes, missed ports, early disembarkation, illness/injury, weather, mechanical issues, government actions, or other events beyond LWCC’s control once travel has commenced.
  4. Travel Insurance
Travel insurance is available but not required; however, LWCC strongly recommends it due to nonrefundable deposits and potentially strict cruise line penalties.
  5. Acknowledgment
By making a payment, the participant acknowledges and accepts these terms, including the cruise line cancellation schedule above and LWCC’s nonrefundable deposits/fees.

7) International Guests and International Itineraries

1. International guests are welcome.

2. Some future cruises may be international.

3. You are responsible for passports, visas, entry/exit requirements, customs rules, vaccinations/health documents, and compliance with all laws at ports of call.

8) LWCC Code of Conduct (General)

LWCC is a faith-based environment intended to support spiritual growth, fellowship, and safe community. You agree you will not engage in conduct that is unsafe, illegal, disruptive, sexually inappropriate, harassing, or contrary to the LWCC environment. This includes, without limitation:

harassment, threats, bullying, hate speech

fighting/assault

theft, vandalism, damage to property

sexual harassment or unwanted advances

disorderly conduct, repeated disruption of sessions/events

refusal to follow reasonable instructions from LWCC staff or ship staff

9) Zero-Alcohol Policy for ALL LWCC Attendees (YA + Family)

This is the most important rule and applies to every LWCC Participant regardless of age or program.

1. Total ban for LWCC Participants. No LWCC Participant may consume, possess, store, bring, purchase, or attempt to purchase alcohol or alcoholic beverages during the LWCC Program.

2. No exceptions in port. Alcohol is not permitted for LWCC Participants even in port or off-ship during the LWCC travel period.

3. Enforcement standard (reasonable suspicion). LWCC may enforce this policy based on reasonable suspicion, including (without limitation): smelling of alcohol, appearing intoxicated, behavior consistent with impairment, witness reports, physical evidence, ship security findings, or admission.

4. Ship rules also apply. Royal Caribbean has its own alcohol policy and may enforce its Guest Conduct Policy up to disembarkation for alcohol violations.

10) Drugs, Vapes, Smoking, and Similar Items (ALL LWCC Attendees)

1. Illegal drugs and illegal substances are prohibited. (And cruise lines also prohibit illegal drugs/substances as prohibited items.)

2. Vapes/e-cigarettes are prohibited in LWCC spaces and events (including conferences, sessions, and gatherings). LWCC does not want LWCC Participants using them during the LWCC travel period.

3. Smoking is prohibited in LWCC spaces and events. Even if the ship has designated smoking areas, LWCC does not want LWCC Participants smoking during the LWCC travel period.

4. CBD and similar products: If not for a legitimate medical reason, they should not be used. LWCC may request reasonable documentation.

11) Christ-Centered Conduct Standard

1. The LWCC Program is designed to provide a Christ-centered environment focused on worship, fellowship, spiritual growth, community, and personal encouragement.

2. Participants are expected to conduct themselves in a manner that reflects Christian values, integrity, respect for others, and the mission of LWCC throughout the duration of the Program.

3. Conduct that is sexually inappropriate, intentionally provocative, excessively disruptive, inconsistent with a faith-based environment, or otherwise undermines the purpose of the Program is prohibited.

4. Participants are expected to exercise sound judgment and avoid behavior, activities, or environments that reasonably conflict with the Christ-centered nature of the LWCC Program.

5. LWCC reserves the right to address conduct concerns on a case-by-case basis and may take appropriate action when conduct is determined, in good faith, to be inconsistent with these standards.

12) Cabin Conduct and Accountability Standards

1. LWCC seeks to maintain a Christ-centered environment that promotes personal integrity, accountability, respect for others, and biblical values.

2. Participants are expected to exercise good judgment and conduct themselves appropriately in cabins, lodging areas, and other private spaces throughout the Program.

3. Sexual activity, sexual misconduct, inappropriate romantic behavior, cohabitation arrangements inconsistent with LWCC standards, and conduct intended to circumvent accountability expectations are prohibited during the LWCC Program.

4. Participants are encouraged to avoid situations that could reasonably compromise personal accountability, create unnecessary temptation, or undermine the Christ-centered environment of the Program.

5. LWCC may address situations involving cabin conduct, private-space behavior, or accountability concerns on a case-by-case basis and may impose consequences where conduct is determined, in good faith, to violate these standards.

6. Ship security, venue staff, lodging providers, and other applicable authorities retain authority over their respective facilities and may impose additional requirements, restrictions, or enforcement measures.

13) Dress Code

Dress should be appropriate to the specific event/activity you are attending and consistent with a respectful, faith-based environment. LWCC may deny entry to LWCC events for attire deemed inappropriate.

14) Minors (Additional Rules)

YA Cruise

Any approved minor under 18 must be placed in the ship’s daycare/kids club as required by LWCC (see Section 3.1).

Family Cruise

Minors must be accompanied by a parent/guardian.

Parents/guardians are responsible for minors’ conduct, safety, supervision, and compliance.

Parental Financial Responsibility and Indemnification

Parents or legal guardians agree they are fully responsible for the supervision, conduct, and safety of their minor at all times (except where the cruise line assumes temporary supervision through official youth programs). LWCC does not assume parental responsibilities and is not acting in loco parentis.

Parents/guardians agree to:

• be financially responsible for any violation fees, damages, losses, or penalties caused by their minor,

• indemnify and hold LWCC harmless from claims arising from their minor’s actions or participation,

• immediately cooperate with LWCC staff and ship security if issues arise involving their minor.

Failure to supervise or cooperate may result in removal from LWCC events without refund.

15) Consequential Fees, Removal, and Enforcement

1. Minimum fee per rule broken. There will be a consequential fee starting at $500.00 per rule broken. Participant acknowledges that such fees represent reasonable administrative and consequential damages resulting from rule violations and are not intended as a penalty.

2. No maximum; scalable consequences. Fees may scale upward depending on severity, repetition, impact on others, costs to LWCC, and involvement of ship security. There is no maximum, only a minimum.

3. Removal from LWCC events. LWCC may remove you from any LWCC event/session (temporarily or permanently) for violations or suspected violations.

4. Ship security involvement. If ship security intervenes, they have final say for onboard consequences, which may include disembarkation at your expense.

5. Family removal (case-by-case). In Family Cruise situations, LWCC may remove an individual or the entire family from LWCC events depending on the circumstances and safety concerns.

6. How fees are charged. Fees may be charged to the card on file or collected in another method LWCC determines best fits the situation.

7. No appeals/refunds of fees. Fees are final and nonrefundable.

LWCC retains sole and reasonable discretion in interpreting and enforcing these Terms, and its good-faith determinations regarding violations shall be given deference to the fullest extent permitted by law.

16) Searches, Confiscation, Cooperation

1. LWCC may inspect and enforce. You agree LWCC may:

inspect bags/items brought into LWCC-controlled events (where legally permitted),

confiscate prohibited items in LWCC spaces/events,

require you to leave an event pending investigation.

2. Prohibited items and weapons. Weapons and prohibited items are banned for LWCC Participants consistent with cruise line rules; items not listed may still be prohibited by ship security leadership.

3. Refusal to cooperate. Refusal to cooperate with reasonable LWCC compliance steps may be treated as a violation.

17) Excursions (Not Run by LWCC)

1. Shore excursions may be offered by the cruise line or third parties.

2. LWCC does not operate excursions. Any excursion you book is at your own risk.

3. Separate waiver. LWCC may require a separate waiver for certain activities or third-party events.

18) Health, Safety, and Fitness to Travel

1. You must comply with all cruise line health/safety policies and applicable law, including requirements related to illness, medical screening, and onboard safety procedures.

2. LWCC may deny participation in LWCC events if your condition or behavior presents a safety risk to others, as reasonably determined.

19) Photography, Video Recording, and Media Release

Adults (18+)

1. Consent is required and granted. By participating, you grant LWCC permission to photograph, record, livestream, and use your likeness/voice in photos/video/audio captured during LWCC events for LWCC purposes including marketing and promotions, without further compensation.

2. No opt-out for adults. Participation constitutes consent.

Minors (Family Cruise and approved YA minors)

1. Parent/guardian consent. A parent/guardian consents to media capture of their minor child as part of participation.

2. Opt-out by request (best efforts). A parent/guardian may opt out on the ship by notifying LWCC staff. LWCC will use reasonable efforts to avoid featuring that child in posed/intentional recordings; however, LWCC cannot guarantee exclusion from incidental background capture in crowded/public environments.

20) Chargebacks, Nonpayment, and Blacklisting

1. If you initiate a chargeback for a charge you authorized or for services delivered in accordance with these Terms, LWCC may:

dispute the chargeback with evidence of consent/participation,

assess additional administrative costs where permitted,

blacklist you from future LWCC participation.

21) Dispute Terms and Governing Rules

1. Cruise line disputes. Any onboard disputes, injuries, incidents, or cruise-related legal claims may be governed by the Cruise Line Terms, including forum selection, limitations, and procedures.

2. LWCC disputes (event organizer matters). To the extent a dispute concerns LWCC-only services (not the cruise line), Florida law will generally apply unless the Cruise Line Terms require otherwise for the specific claim. Where required, the Cruise Line Terms control onboard and passage-related matters.

22) Disclaimers and Limitation of LWCC Responsibility

1. No control of ship operations. LWCC is not responsible for acts/omissions of the cruise line, ship crew, ship security, port authorities, or third-party vendors.

2. No guarantee of participation. LWCC may deny or revoke participation for violations or safety concerns.

3. Force majeure / changes. LWCC may modify programming, schedules, or policies as necessary due to safety, compliance, ship requirements, or events outside LWCC’s control.

23) Updates to These Terms

LWCC may update these Terms for future bookings. The version in effect at the time of your booking/acceptance applies unless an update is required by law or the cruise line, in which case the updated terms apply as needed. LWCC’s failure to enforce any provision of these Terms in one instance does not waive its right to enforce that provision or any other provision in the future.

24) Acknowledgment (Checkout Language You Should Put Under the Checkbox)

By booking/participating, you acknowledge:

Deposits are nonrefundable.

Zero alcohol applies to you at all times during LWCC travel, including ports.

$500 minimum fee per rule broken (no maximum) and removal from events may occur.

Ship security has final say onboard.

You consent to photography/video under these Terms.

25) Limits on Claims, Dispute Resolution, and Class Action Waiver

1. Acknowledgment of Rules / Assumption of Risk.

You acknowledge that you are voluntarily participating in a faith-based group travel and event program with behavioral standards (including, without limitation, the zero-alcohol policy and conduct rules). You agree that LWCC’s rules and enforcement decisions are intended to protect the experience, safety, and mission of the group, and you assume the foreseeable risks of participating in a group environment and being subject to conduct standards and enforcement actions.

You further acknowledge that cruise travel and large group events involve inherent risks, including but not limited to illness outbreaks (including communicable diseases), medical emergencies, maritime hazards, weather disruptions, international travel risks, evacuation risks, shipboard incidents, port authority actions, itinerary changes, security interventions, and the behavior of other passengers. You voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, and accept personal responsibility for your participation.

2. No Claims Based Solely on Disagreement With Rules.

To the maximum extent permitted by law, you agree you will not bring claims against LWCC based solely on your disagreement with LWCC’s faith-based conduct standards, the existence of those standards, or LWCC’s good-faith enforcement of those standards (including removal from LWCC events), provided LWCC acted in good faith and consistent with these Terms.

3. Limitation of Liability (LWCC).

To the maximum extent permitted by law:

• LWCC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of enjoyment, lost profits, emotional distress, reputational harm, or similar damages, even if LWCC was advised of the possibility of such damages.

• LWCC’s total liability for any claim arising out of or relating to the LWCC Program will not exceed the total amount actually paid by you to LWCC for the specific sailing giving rise to the claim (excluding amounts paid to the cruise line or third parties), unless a higher amount is required by applicable law.

4. Third-Party / Cruise Line Responsibility.

You agree that LWCC is not responsible for acts or omissions of the cruise line, ship crew, ship security, port authorities, third-party excursion operators, or other vendors. Onboard incidents, security actions, and cruise operations are controlled by the cruise line and may be governed by the cruise line’s passenger ticket contract and policies, including federal maritime law where applicable.

5. Required Notice and Informal Resolution.

Before filing any formal claim against LWCC, you must send written notice describing the issue and the relief requested to info@livingwaterchristiancruise.com and allow LWCC thirty (30) days to attempt to resolve the dispute informally. This notice requirement does not apply where prohibited by law.

6. Binding Individual Arbitration (LWCC Disputes Only).

Except where prohibited by law or where the cruise line’s passenger ticket contract requires a different process for a particular claim, you and LWCC agree that any dispute, claim, or controversy arising out of or relating to LWCC (including these Terms, LWCC programming, LWCC fees, or LWCC rule enforcement) will be resolved by binding arbitration on an individual basis, and not in court.

• Arbitration shall be administered under the Commercial Arbitration Rules of the American Arbitration Association (AAA) or another comparable arbitration service selected by LWCC.

• Arbitration venue: Florida, or remote/virtual as permitted by the arbitrator.

• Governing law: Florida law, to the extent not preempted or overridden by controlling cruise line terms for a specific claim.

• Each party shall bear its own attorney’s fees unless the arbitrator awards fees under applicable law.

• The arbitrator shall not have authority to award punitive or exemplary damages unless required by law.

• Small claims exception: Either party may bring an eligible claim in small claims court instead of arbitration, if allowed by law.

7. Jury Trial Waiver.

To the maximum extent permitted by law, you and LWCC waive any right to a trial by jury in any legal proceeding arising out of or relating to these Terms or the LWCC Program.

8. Class Action Waiver.

You agree that you may bring claims against LWCC only in your individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general action, to the maximum extent permitted by law.

9. Time Limit to Bring Claims.

To the maximum extent permitted by law, any claim you have against LWCC must be initiated within one (1) year from the date of the event giving rise to the claim, or it is permanently barred, unless a longer period is required by applicable law.

10. Severability / Survival.

If any part of this Section is found unenforceable, the remaining parts will remain in effect to the maximum extent permitted by law. This Section survives the end of your participation.

26) Event Tickets, Venue Rules, and Removal for Non-Compliance

1. Ticket Purchase = Agreement.

By purchasing, reserving, receiving, or using a ticket (paid or free) for any Living Water Christian Cruise (“LWCC”) event (including onboard sessions, meetups, conferences, worship nights, and any off-ship/on-land events), you acknowledge and agree to:

  • these Terms of Service,
  • the rules listed in the event description, registration page, and/or confirmation email,
  • and any additional rules, instructions, or policies communicated by LWCC or the venue.

2. Venue Rules and Staff Authority.

You agree to comply with all rules set by the venue (including the ship, hotel, theater, church, rented hall, or other location) and all instructions from:

  • LWCC staff/volunteers,
  • venue staff/security,
  • and (if applicable) ship security/crew.
Venue/security personnel may have final authority over safety and removal decisions at the location.

3. Rules May Be Updated or Added. LWCC may establish or modify event rules:

  • before the event (including at check-in or via email/text/announcements),
  • during the event (including on-site announcements),
  • and as required by the venue for safety, compliance, capacity, or operational reasons.
These rules are enforceable even if not listed word-for-word in advance, provided they are reasonable and communicated.

4. Denied Entry / Removal; No Refunds.

LWCC may refuse entry or remove you from an event (temporarily or permanently) if, in LWCC’s reasonable judgment, you violate or are suspected of violating any applicable rules, including but not limited to:

  • alcohol/drug/vape/smoking restrictions,
  • harassment or disruptive/disorderly behavior,
  • safety violations,
  • refusal to follow LWCC or venue staff instructions,
  • attempting to bypass eligibility requirements (age, wristbands, tickets, check-in),
  • or conduct that threatens the experience or safety of others.
If you are denied entry or removed for any of the above, no refund will be issued, and LWCC may assess violation fees where permitted by these Terms.

5. No Circumventing Enforcement.

You may not re-enter an event after removal, attempt to transfer or use a ticket after being removed, or use another person’s ticket/credentials to enter. Attempting to circumvent enforcement is a separate violation and may result in additional fees and/or permanent removal from LWCC events.

6. Restricted Areas; Safety Compliance.

You agree to respect restricted areas (crew-only, staff-only, backstage, private rooms) and comply with posted signage and all safety requirements.

7. Assumption of Risk / Personal Responsibility.

You assume ordinary risks associated with attending group events (crowds, noise, movement, and venue conditions) and agree to act responsibly and lawfully at all times.

27) Indemnification and Hold Harmless

1. Participant Indemnification Obligation.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Living Water Christian Cruise (LWCC), its founders, directors, officers, volunteers, representatives, agents, contractors, affiliated ministries, and assigns from and against any and all claims, demands, actions, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable attorney’s fees and legal costs) arising out of or relating to:

• your violation of these Terms,

• your violation of cruise line rules or applicable law,

• your conduct during the LWCC Program or related travel,

• damage to property or injury to any person caused by you,

• ship security involvement resulting from your actions,

• any third-party claim arising from your behavior,

• any fines, penalties, or costs assessed against LWCC due to your conduct.

2. Defense Obligation.

LWCC reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully in the defense of such claim.

3. Survival.

This Section survives the completion or termination of your participation in the LWCC Program.

28) No Personal Liability of Individuals

  1. No Personal Liability.

To the fullest extent permitted by law, no founder, director, officer, volunteer, staff member, representative, or affiliated individual of LWCC shall be personally liable for any claims, damages, losses, or liabilities arising out of or related to the LWCC Program, these Terms, or any enforcement action taken in good faith.

  2. Claims Against Entity Only.

Any claim must be brought solely against the LWCC organizing entity and not against individuals in their personal capacity, except where prohibited by applicable law in cases of proven willful misconduct.

29) Maritime Law and Cruise Operations Acknowledgment

You acknowledge that cruise travel is subject to federal maritime law and the cruise line’s passenger ticket contract, which may contain limitations on liability, shortened time limits for claims, forum selection requirements, and other binding legal terms.

LWCC is not a carrier, vessel operator, or maritime transport provider. LWCC does not control the vessel, ship crew, navigation, ship security, or cruise operations.

You agree that LWCC shall not be liable for matters arising from ship operations, seaworthiness, navigation, security actions, port authority decisions, itinerary changes, mechanical issues, medical evacuations, or maritime incidents.

Where maritime law or the cruise line’s ticket contract applies, those provisions control.

30) False Statements, Defamation, and Non-Circumvention

  1. False Allegations.

You agree not to knowingly make false statements, defamatory claims, or misleading public allegations regarding LWCC, its leadership, volunteers, or participants.

  2. Disruptive Public Conduct.

LWCC reserves the right to remove or permanently bar any participant who engages in conduct intended to damage the reputation, mission, or operations of LWCC through knowingly false or malicious actions.

  3. No Circumvention of Enforcement.

You may not attempt to bypass removal decisions, re-enter events after removal, transfer credentials to avoid enforcement, or misrepresent your eligibility. Doing so constitutes a separate violation subject to additional fees.

31) Fraud, Misrepresentation, and Payment Disputes

  1. Accurate Information Required.

You represent that all information provided during booking and participation (including age, identity, and eligibility) is truthful and accurate.

  2. Fraudulent Conduct.

Providing false information, misrepresenting age, using unauthorized payment methods, or attempting to bypass cruise line age or assignment rules constitutes a material breach of these Terms.

  3. Chargebacks.

If you initiate a chargeback for a charge that you authorized or for services delivered consistent with these Terms, LWCC may dispute the charge and recover administrative costs, fees, and damages to the maximum extent permitted by law. LWCC may also permanently deny future participation.

32) Missed Embarkation; Travel Documentation Responsibility

  1. Sole Responsibility for Timely Boarding.

Participant bears sole responsibility for arriving at the port of embarkation on time, completing all check-in and boarding requirements, clearing security, and boarding the vessel within the timeframes established by the cruise line, port authorities, and applicable officials.

  2. No Liability for Missed Embarkation.

LWCC shall have no responsibility or liability whatsoever if Participant misses embarkation or otherwise fails to board the vessel for any reason, including but not limited to late arrival, traffic delays, flight delays, transportation interruptions, personal scheduling errors, misunderstanding of boarding times, or failure to comply with embarkation procedures or instructions.

  3. Participant Responsibility for Travel Documents.

Participant is solely responsible for obtaining, maintaining, and presenting all documents required for travel and boarding, including, without limitation, passports, visas, government-issued identification, birth certificates, parental consent documentation, health or vaccination records, and any other documentation required by the cruise line, port authorities, customs officials, immigration authorities, or applicable law.

  4. Consequences of Missing or Invalid Documentation.

If Participant is denied boarding, delayed, refused entry, removed from travel, or otherwise unable to embark or continue travel due to missing, invalid, expired, inaccurate, or insufficient documentation, such circumstance shall be deemed solely the responsibility of Participant. LWCC shall not be liable for any resulting losses, damages, expenses, delays, penalties, or denied refunds.

  5. No Duty to Review or Verify.

Any information, reminder, or assistance provided by LWCC regarding boarding requirements or travel documentation is provided solely as a courtesy and shall not create any duty on the part of LWCC to review, confirm, verify, or guarantee the sufficiency, validity, or acceptance of Participant’s documents by the cruise line or any governmental or regulatory authority.

  6. Treatment as No-Show or Cancellation.

Failure to board the vessel due to untimely arrival or failure to possess required documentation may be treated as a no-show or same-day cancellation and may result in forfeiture of all amounts paid, subject to the applicable cruise line cancellation policy and LWCC’s nonrefundable deposits and fees.

33) Sponsorships, Partnerships, and Brand Participation

1. Nature of Sponsorship

Sponsorships with Living Water Christian Cruise (LWCC) are considered mission-aligned contributions in exchange for limited visibility, recognition, and participation opportunities. Sponsorships do not constitute ownership, partnership, joint venture, or endorsement unless explicitly stated in writing by LWCC.

All sponsorships are subject to acceptance and approval at LWCC’s sole discretion.

2. Sponsorship Approval and Discretion

LWCC reserves the absolute right to approve, deny, or remove any sponsor for any reason, including but not limited to misalignment with LWCC’s Christian mission, values, brand standards, or reputational considerations.

Submission of a sponsorship inquiry form does not guarantee acceptance, availability, placement, or participation.

3. Sponsorship Agreements Required

All sponsors must enter into a separate written sponsorship agreement with LWCC. In the event of any conflict between these Terms and a sponsorship agreement, LWCC may determine which terms control.

4. Payments, Deposits, and Refunds

• Sponsorship payments and deposits are nonrefundable unless LWCC explicitly agrees otherwise in writing.

• LWCC may allow payment plans or deposits at its discretion.

• If a sponsor cancels, all amounts paid are forfeited.

If a sailing is canceled:

• LWCC may offer a credit toward a future sailing or issue a refund at its discretion.

If a sailing is delayed, modified, or experiences changes:

• Sponsorship remains active and no refund is required.

5. Sponsorship Benefits and No Guarantees

All sponsorship benefits—including but not limited to mentions, exposure, visibility, participation opportunities, and recognition—are:

• subject to cruise line rules,

• subject to shipboard restrictions and approvals,

• subject to operational limitations, safety considerations, weather, and scheduling,

• subject to change at any time at LWCC’s discretion.

LWCC does not guarantee any specific level of exposure, attendance, impressions, engagement, leads, or return on investment.

LWCC may modify, substitute, reschedule, or cancel any sponsor benefit at any time as needed.

6. Onboard Restrictions and Advertising Limitations

Sponsors acknowledge that:

• Physical advertising, sales booths, or promotional setups on the ship may be prohibited or restricted by the cruise line.

• Sponsors are not guaranteed the ability to physically promote or advertise onboard.

• Sponsor visibility may be limited to mentions during LWCC programming, conferences, or approved activities.

All onboard activity is subject to cruise line rules and final approval.

7. Sponsor Conduct and Compliance

Sponsors and all sponsor representatives must comply with:

• these Terms,

• LWCC conduct rules (including alcohol, behavior, and environment standards),

• all cruise line rules and policies.

LWCC may revoke sponsor privileges, remove sponsor representatives, or terminate participation for any violation or conduct inconsistent with LWCC’s mission or standards.

No refund will be issued in such cases.

8. Mission Alignment and Content Restrictions

Sponsors must align with LWCC’s Christian mission and values.

LWCC may reject, remove, or require modification of any sponsor:

• branding,

• messaging,

• materials,

• products,

9. Branding, Intellectual Property, and Usage Rights

By becoming a sponsor, you grant LWCC a non-exclusive, royalty-free, worldwide license to use your name, logo, brand assets, and submitted materials for purposes related to the LWCC Program, including promotion, marketing, and event execution.

Sponsors may not use LWCC’s name, logo, or brand in a way that implies endorsement, partnership, or affiliation beyond the agreed sponsorship without prior written approval.

LWCC reserves the right to approve, edit, or reject all sponsor-submitted materials.

10. Sponsor Materials and Deadlines

Sponsors are responsible for providing all required materials (logos, graphics, copy, etc.) in a timely manner and in the format requested by LWCC.

LWCC is not responsible for reduced visibility or missed benefits due to late, incomplete, or unusable submissions.

11. Giveaways, Promotions, and Distribution

Sponsors may not conduct giveaways, raffles, contests, or promotions onboard unless explicitly approved by LWCC.

Any approved sponsor promotion:

• must comply with all applicable laws and cruise line rules,

• must be fully administered by the sponsor,

• and remains the sole responsibility of the sponsor.

Sponsors may not distribute materials, products, or items that are illegal, unsafe, offensive, restricted, or prohibited by LWCC or the cruise line.

12. No Access to Attendee Data

Sponsors are not entitled to attendee personal data, contact information, or direct access to participants.

All communication must go through LWCC or authorized sponsor coordinators unless explicitly approved.

13. Sponsor Representations and Warranties

Sponsors represent and warrant that:

• all materials and content provided are accurate, lawful, and not misleading,

• they own or have rights to all materials submitted,

• their content does not infringe on any third-party rights,

• and their products, services, and claims comply with applicable laws.

Sponsors are solely responsible for all claims related to their brand, products, services, and messaging.

14. Indemnification by Sponsors

Sponsors agree to defend, indemnify, and hold harmless LWCC and its representatives from any claims, damages, losses, liabilities, or expenses arising out of:

• sponsor conduct,

• or any breach of these Terms.

15. Limitation of Liability (Sponsors)

To the maximum extent permitted by law:

• LWCC’s total liability to any sponsor shall not exceed the total amount paid by that sponsor to LWCC.

• LWCC shall not be liable for indirect, incidental, consequential, or reputational damages, or loss of business or profits.

16. Non-Exclusivity

Unless explicitly stated in writing, sponsorships are non-exclusive. LWCC may accept multiple sponsors, including those in similar or competing categories.

17. Termination

LWCC may terminate or suspend any sponsorship at any time for:

• nonpayment,

• rule violations,

• mission misalignment,

• reputational concerns,

• legal or compliance risks,

• or operational limitations.

If terminated for cause, no refund will be issued.

LWCC may also permanently deny future participation.

• Winners will be selected by LWCC executives through random drawing or entry-based criteria, as applicable.

• Winners will be notified via email, public announcement, and/or phone call.

Winners must respond within twenty-four (24) hours of notification. Odds of winning depend on the number of eligible entries received, unless otherwise stated in the official rules for a specific Giveaway.

If a winner does not respond within the required time:

• the prize may be forfeited,

• and an alternate winner may be selected.

LWCC is not responsible for missed communications, incorrect contact information, spam filters, or technical failures.

5. Prizes

Prizes may include, but are not limited to:

6. Sponsor-Provided Prizes

If a sponsor provides a prize:

• the sponsor is solely responsible for fulfillment, delivery, taxes, warranties, and any claims related to the prize,

• LWCC is not responsible for sponsor-provided prizes or related issues.

Sponsors may not collect participant information or contact entrants without LWCC’s prior approval.

All sponsor-related giveaways must be approved by LWCC in advance.

7. Taxes and Expenses

Winners are solely responsible for:

• any taxes, fees, or reporting obligations,

• any expenses not expressly included in the prize.

LWCC or sponsors may issue required tax documentation where applicable.

8. Conduct and Disqualification

LWCC may disqualify any participant, at its sole discretion, for:

• violation of these Terms,

• providing false or misleading information,

• cheating, fraud, or manipulation of the Giveaway,

• harassment or inappropriate behavior,

• conduct inconsistent with LWCC’s mission or environment.

Participants removed from the LWCC Program for conduct violations are automatically disqualified from any Giveaways.

9. Publicity and Media Use

By entering or winning a Giveaway, participants agree that LWCC may use their name, likeness, image, testimony, city/state of residence, and social media handle for promotional, marketing, publicity, and content purposes without additional compensation, unless prohibited by law. Winners may also be required to sign a winner confirmation, eligibility affidavit, liability release, publicity release, or similar documentation as a condition of receiving a prize where permitted by law.

10. Fraud, Tampering, and Abuse

Participants may not:

• submit multiple fraudulent entries,

• use bots or automated systems,

• manipulate or interfere with the Giveaway process.

LWCC reserves the right to void any entries or disqualify participants where fraud or abuse is suspected. LWCC is not responsible for late, lost, incomplete, illegible, misdirected, corrupted, delayed, or technically malfunctioning entries or transmissions.

If a Giveaway is canceled, LWCC shall have no obligation except as required by applicable law.

13. Legal Compliance

All Giveaways are:

• void where prohibited,

• subject to applicable federal, state, and international laws,

• subject to cruise line rules and restrictions where applicable.

Participants are responsible for ensuring they are eligible under their local laws. LWCC may also require compliance with platform-specific rules or disclosures for any Giveaway conducted through social media, email, text, or third-party platforms.

14. Supplemental Giveaway Rules.

LWCC may publish separate or supplemental official rules for any specific Giveaway, including rules relating to eligibility, entry methods, start and end dates, prize descriptions, winner selection, response deadlines, geographic restrictions, sponsor involvement, platform-specific requirements, and other operational details.
